Delivery Terms and Conditions

Shipment and Title Transfer**: Unless otherwise agreed in writing, delivery shall be made and title shall pass to Buyer F.O.B. point of shipment. Buyer shall assume all expenses and risk of loss associated with transportation of goods from the point of shipment.

Delivery Dates: All delivery dates provided are approximate and contingent upon Buyer’s prompt provision of all necessary information. Classic Hydraulics (“Seller”) shall not be held liable for any delays in delivery.

Taxes: Quoted prices exclude any present or future sales taxes. All taxes shall be the sole responsibility of the Buyer.

Force Majeure and Limitation of Liability

Force Majeure Events: Seller shall not be held liable for any failure or delay in manufacture, shipment, or delivery of products resulting from causes beyond Seller’s reasonable control, including but not limited to:

  • Acts of God or natural disasters
  • Government actions or regulations
  • Accidents, explosions, fires, or other casualties
  • Labour disputes, strikes, or lockouts
  • Wars, terrorist acts, or civil unrest
  • Shortages or inability to secure labour, raw materials, production, or transportation facilities

Approximate Shipping Dates: Shipping dates are approximate and based on conditions at the time of quotation. Seller shall not be liable for failure or delay in performance due to prior sale of Products.

Extension of Delivery Date: In the event of a delay caused by any of the aforementioned circumstances, there shall be no termination of the agreement. The delivery date shall be extended for a period equal to the duration of the delay.

Limitation of Liability: In no event shall Seller be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the delivery or use of the Products, regardless of the cause of action.

By placing an order with Seller, Buyer acknowledges and agrees to these terms and conditions.
